Tolera Terms of Service

These Terms of Service ("Terms") govern your use of the Tolera mobile application ("the App"). By installing or using the App you agree to these Terms. If you do not agree, do not use the App.

This agreement is between you and the developer of Tolera. Apple is not a party to these Terms and is not responsible for the App or its content.

License

The developer grants you a limited, non-transferable, non-exclusive, revocable license to install and use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and the Usage Rules of the App Store. You may not copy, modify, reverse-engineer, decompile, or distribute the App, except where applicable law expressly permits.

Informational Use Only

Tolera is a self-tracking tool for personal information about meals, symptoms, and food sensitivities. Tolera is not a medical device. The App does not provide medical advice, diagnosis, or treatment. Information shown in the App — including AI-generated meal analysis, FODMAP categorisations, and any computed correlations — is informational and may be incomplete or inaccurate. Always consult a qualified healthcare professional before making decisions about your diet or health.

Tolera Plus Subscription

Tolera offers an optional auto-renewing subscription called Tolera Plus, available as a monthly or annual product through the App Store. Pricing is shown in the App at the time of purchase and is charged to your Apple ID account.

Your subscription automatically renews at the end of each period unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period at the price of the selected subscription.

If a free trial is offered and you start one, any unused portion of the free trial is forfeited when you purchase a subscription, where applicable. Cancel before the trial ends to avoid being charged.

Managing or Cancelling Your Subscription

You can manage and cancel your subscription at any time in Settings → Apple ID → Subscriptions on your device, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period; you keep access to Tolera Plus until then. The developer cannot cancel your subscription on your behalf — Apple manages billing and renewals.

Refunds

All payments for Tolera Plus are processed by Apple and refunds are handled by Apple under their refund policy. Request a refund at reportaproblem.apple.com.

Acceptable Use

You agree not to use the App to violate any applicable law, infringe anyone's rights, or attempt to disrupt, probe, or reverse-engineer the App or the services it depends on. You are responsible for the content you enter into the App, including meal photos and descriptions.

Third-Party Services

The App uses third-party services to function, including Apple's App Store, Apple HealthKit (only if you grant permission), a Cloudflare Worker operated by the developer that forwards meal-analysis requests to Anthropic's Claude API, and food databases such as Open Food Facts and the USDA FoodData Central API. Use of those services is also subject to their own terms. The developer is not responsible for the availability or accuracy of third-party services.

Intellectual Property

The App, including its name, logo, code, and design, is the property of the developer and is protected by copyright and other intellectual-property laws. These Terms do not transfer any ownership rights to you.

Warranty Disclaimer

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that the App will be uninterrupted, error-free, or accurate.

Limitation of Liability

To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the App. Where liability cannot be excluded under applicable law, the developer's total liability is limited to the amount you paid for the App in the twelve months preceding the claim, or, if greater, the minimum amount required by applicable law.

Termination

You may stop using the App at any time by deleting it from your device. The developer may suspend or terminate access to the App or any feature for any user who violates these Terms.

Changes to These Terms

The developer may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the App after a change indicates that you accept the updated Terms.

The following terms apply because you obtained the App through the App Store:

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Nothing in these Terms limits any consumer rights you may have under the mandatory laws of your country of residence.
